As a pedestrian, when you walk down a street the thought rarely crosses your mind that you may in fact be in danger. The sad truth is thousands of people are injured every year in pedestrian accidents.
The National Highway Traffic Association reported that more than five thousand people die in pedestrian accidents every year, with much more seriously injured. Young children and seniors over 70 years old are in the highest risk category for being hit by a motor vehicle.
All drivers have a duty of care towards others on the road or around them; they are responsible for making sure they adhere to road safety rules.
California Vehicle Code Section 21950(a) states, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.”
There are exceptions. Pedestrians are required to watch out for their own safety. They should not suddenly leave a curb and walk into the path of a vehicle. In addition, it would be wise if pedestrians didn’t unnecessarily stop or delay traffic while in a marked or unmarked crosswalk.
However, if a pedestrian does step into the roadway suddenly, the driver should make every effort to safely stop and avoid hitting them.
